Terms of Service & End User License Agreement (EULA)

1. Acceptance of Terms

By accessing or using Tingo, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you agree to these Terms. If you are under 18, you must have your parent or guardian's permission to use the App.

2. Description of Service

Tingo is a real-world scavenger hunt bingo game. Players are given bingo-style boards filled with items to find or spot in the physical world around them. The App may include single-player and multiplayer modes, leaderboards, and social features.

3. User Accounts

You may be required to create an account to use certain features of Tingo. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscriptions & Payments

Tingo offers optional purchases, including one-time game unlocks and an auto-renewable subscription. All purchases are processed through your app store account (the Apple App Store or Google Play), not directly by us.

• Auto-renewal: Subscriptions automatically renew at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period.
• Managing and canceling: You can manage or cancel a subscription anytime in your device's account settings (Apple: Settings → your name → Subscriptions; Google Play: Play Store → Subscriptions). Cancellation takes effect at the end of the current billing period. We cannot cancel store-managed subscriptions on your behalf, and there is no in-app cancellation.
• Refunds: Refund requests are handled by the applicable app store under its own policies.
• Price changes: Prices may change. Where required, we will provide advance notice, and changes apply only to future billing periods.

5. Acceptable Use

You agree not to use Tingo to:

• Violate any applicable laws or regulations
• Harass, bully, or harm other users
• Submit false, misleading, or inappropriate content
• Attempt to reverse-engineer, hack, or disrupt the App
• Use automated bots or scripts to interact with the App
• Trespass on private property in pursuit of in-game objectives

Safety reminder: Always be aware of your surroundings while playing Tingo. Never trespass, take unnecessary risks, or endanger yourself or others while playing.

6. License to Use the App (EULA)

These Terms also serve as the End User License Agreement ("EULA") between you and Big Tree Little Tree LLC. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Tingo for your personal, non-commercial use, in accordance with the usage rules of the app store from which you obtained the App.

7. Apple App Store — Additional Terms

The following additional terms apply if you download Tingo from the Apple App Store, as required by Apple Inc. ("Apple"):

• These Terms are entered into between you and Big Tree Little Tree LLC only, and not with Apple. Big Tree Little Tree LLC, not Apple, is solely responsible for Tingo and its content.
• The license granted to you is limited to a non-transferable license to use Tingo on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Apple has no obligation to furnish any maintenance or support services for Tingo. Big Tree Little Tree LLC is solely responsible for maintenance and support.
• Big Tree Little Tree LLC is solely responsible for any product warranties, whether express or implied. If Tingo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to Tingo.
• Big Tree Little Tree LLC, not Apple, is responsible for addressing any claims relating to Tingo, including product liability, any failure to conform to legal or regulatory requirements, consumer protection claims, and claims that Tingo infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
• Apple's standard Licensed Application End User License Agreement is incorporated into these Terms by reference. Where it sets minimum terms for the license to use Tingo, those terms govern for App Store downloads in the event of any conflict.

8. Google Play — Additional Terms

If you download Tingo from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for Tingo or its content.

9. Intellectual Property

All content, trademarks, logos, and game mechanics within Tingo are the property of Big Tree Little Tree LLC or its licensors. You may not reproduce, distribute, or create derivative works from any part of the App without our express written permission.

10. User-Generated Content

If you submit photos, descriptions, or other content through Tingo, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with operating and improving the App.

11. Privacy

Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Disclaimers

Tingo is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, uninterrupted, or meet your specific requirements. We are not responsible for any personal injury, property damage, or other harm resulting from gameplay.

13. Limitation of Liability

To the fullest extent permitted by law, Big Tree Little Tree LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Tingo, even if we have been advised of the possibility of such damages.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via the App or email. Continued use of Tingo after changes take effect constitutes your acceptance of the updated Terms.
